1. Agreement to Terms

By accessing or using the website located at 3dcityskyline.com (“Site”), operated by 3D Services USA, LLC, doing business as 3D City Skyline (“Company,” “we,” “us,” or “our”), you (“User,” “you,” or “your”) agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to all of these Terms, you must not access or use the Site or purchase any products or services.

These Terms constitute a legally binding agreement between you and the Company. We reserve the right to modify these Terms at any time. Your continued use of the Site after any changes constitutes acceptance of the updated Terms. It is your responsibility to review these Terms periodically.

2. Eligibility

You must be at least 18 years of age or the age of legal majority in your jurisdiction to use this Site and make purchases. By using the Site, you represent and warrant that you meet this eligibility requirement. If you are using the Site on behalf of a business or entity, you represent that you have the authority to bind that entity to these Terms.

3. Products and Services

3.1 Digital Downloads

We offer digital 3D model files (“Digital Products”) generated from publicly available geographic and cartographic data. Digital Products are delivered electronically in file formats including, but not limited to, STL, 3MF, and GLB. Digital Products are provided “as is” and “as available.”

3.2 Printed Models

We offer physical 3D printed models (“Printed Products”) manufactured using professional 3D printing processes. Printed Products are custom-made to your specifications and may vary slightly in color, texture, finish, and dimensional accuracy from on-screen previews due to the inherent nature of 3D printing technology. Such variations are not considered defects.

3.3 Accuracy Disclaimer

3D models are generated from third-party geographic data sources. While we strive for accuracy, we do not guarantee that any model is a perfectly accurate or complete representation of the real-world location. Models are artistic interpretations of geographic data and are intended for decorative, educational, and personal use only. They must not be relied upon for surveying, navigation, engineering, architectural, legal, or any other professional purpose.

3.4 Large / Multi-Part Models

Models that exceed our standard print dimensions may be automatically divided into multiple parts for production and shipping. Multi-part models are designed for assembly by the customer. Assembly may require adhesive or other materials not provided by us. We are not liable for any difficulties, damages, or dissatisfaction arising from the assembly process.

4. Orders, Pricing, and Payment

4.1 Pricing

All prices are listed in US Dollars (USD) unless otherwise stated. Prices are subject to change without notice. The price charged will be the price displayed at the time of order submission. Applicable taxes and shipping costs are calculated and displayed during checkout.

4.2 Payment

Payments are processed securely through Stripe, Inc. (“Stripe”) on behalf of 3D Services USA, LLC. All charges on your statement and receipts will appear from 3D Services USA, LLC. By making a purchase, you agree to Stripe’s terms of service. We do not store your credit card information on our servers. You are responsible for ensuring that your payment information is accurate and that you have sufficient funds to complete the transaction.

4.3 Order Acceptance

Your submission of an order constitutes an offer to purchase. We reserve the right to accept or decline any order at our sole discretion, for any reason, including but not limited to: pricing errors, suspected fraud, product unavailability, or content that violates these Terms. If we decline your order, we will issue a full refund.

4.4 Taxes

You are responsible for all applicable taxes associated with your purchase. Tax amounts are calculated automatically during checkout based on your shipping or billing address and applicable tax laws.

5. Shipping and Delivery

Printed Products are shipped to the address you provide during checkout. Estimated delivery times are provided as guidelines only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs, weather, natural disasters, or other events beyond our control. Risk of loss and title for Printed Products pass to you upon delivery to the carrier.

You are responsible for providing a correct and complete shipping address. We are not responsible for orders shipped to incorrect addresses provided by you. If a package is returned to us due to an incorrect address, you will be responsible for additional shipping costs to reship the order.

Digital Products are delivered electronically via download links. We are not responsible for your inability to download files due to your internet connection, hardware, software, or other technical issues on your end.

6. Refund and Return Policy

6.1 Printed Products

We offer a 30-day satisfaction guarantee on Printed Products. If you are not satisfied with your Printed Product, you may contact us within 30 days of delivery to request a replacement or refund. To qualify, the product must not have been intentionally damaged, modified, painted, glued (beyond assembly as intended), or altered in any way. We may require photographs of the product and/or return of the product at our discretion. Return shipping costs are the responsibility of the customer unless the product was defective or damaged during shipping.

6.2 Digital Products

Due to the nature of digital goods, all sales of Digital Products are final. Once a Digital Product has been downloaded or made available for download, no refund will be issued. If you experience a technical issue preventing you from accessing your files, please contact us and we will work to resolve the issue.

6.3 Refund Process

Approved refunds will be processed to the original payment method within 5-10 business days. We reserve the right to deny refund requests that do not comply with this policy or that we reasonably believe to be fraudulent or abusive.

7. Intellectual Property

7.1 Our Intellectual Property

All content on the Site, including but not limited to text, graphics, logos, icons, images, software, code, user interface design, and the arrangement thereof, is the exclusive property of the Company or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws. You may not copy, reproduce, modify, distribute, display, perform, transmit, publish, license, create derivative works from, or sell any content from the Site without our prior written permission.

7.2 License for Purchased Products

Upon completing a purchase, we grant you a non-exclusive, non-transferable, personal license to use the purchased Digital Products or Printed Products for personal, non-commercial purposes only. You may not:

  • Resell, redistribute, sublicense, or make available the Digital Products or any derivative works to any third party
  • Use the Digital Products or Printed Products for commercial purposes, including but not limited to resale, commercial display, or incorporation into products or services for sale
  • Claim ownership of the underlying 3D model data, algorithms, generation processes, or software
  • Reverse-engineer, decompile, or attempt to extract the source code or generation algorithms from any Digital Product or the Site
  • Remove or alter any proprietary notices, labels, or marks on Printed Products

Violation of this license may result in termination of your account, legal action, and/or claims for damages.

7.3 Third-Party Data

Our 3D models are generated using publicly available geographic data from third-party providers. We do not claim ownership of the underlying geographic data. The use of this data is subject to the respective third-party terms and licenses.

8. Prohibited Uses

You agree not to use the Site or our products to:

  • Violate any applicable federal, state, local, or international law or regulation
  • Create models of restricted or sensitive locations (military installations, government facilities, critical infrastructure) for any unlawful purpose
  • Engage in any activity that could damage, disable, overburden, or impair the Site
  • Use any automated means (bots, scrapers, crawlers) to access the Site or generate models without our express written permission
  • Attempt to gain unauthorized access to any portion of the Site, other accounts, or computer systems
  • Circumvent or attempt to circumvent any security measures, pricing mechanisms, or access controls
  • Use the products for any purpose that could be considered threatening, harassing, defamatory, or otherwise objectionable

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SITE OR PRODUCTS
  • ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SITE
  • ANY CONTENT OBTAINED FROM THE SITE OR PRODUCTS
  • UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT
  • INACCURACIES IN 3D MODELS COMPARED TO REAL-WORLD LOCATIONS
  • DAMAGES ARISING FROM ASSEMBLY OF MULTI-PART MODELS, INCLUDING PERSONAL INJURY OR PROPERTY DAMAGE
  • ANY USE OF PRODUCTS FOR PROFESSIONAL, ENGINEERING, ARCHITECTURAL, NAVIGATIONAL, OR SURVEYING PURPOSES

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE OR PRODUCTS EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

10. Disclaimer of Warranties

THE SITE AND ALL PRODUCTS AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

WE DO NOT WARRANT THAT: (A) THE SITE WILL FUNCTION UNINTERRUPTED, SECURELY, OR AVAILABLE AT ANY PARTICULAR TIME OR LOCATION; (B) ANY ERRORS OR DEFECTS WILL BE CORRECTED; (C) THE SITE IS FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS; (D) THE RESULTS OF USING THE SITE OR PRODUCTS WILL MEET YOUR REQUIREMENTS; OR (E) ANY 3D MODEL WILL BE AN ACCURATE REPRESENTATION OF ANY REAL-WORLD LOCATION.

11. Indemnification

You agree to defend, indemnify, and hold harmless the Company, its directors, officers, employees, agents, partners, suppliers, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, or expenses (including but not limited to attorney’s fees) arising from: (a) your use of the Site or Products; (b) your violation of these Terms; (c) your violation of any third-party right, including without limitation any intellectual property, property, or privacy right; or (d) any claim that your use of the Products caused damage to a third party.

12. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.

Any dispute, controversy, or claim arising out of or relating to these Terms or the breach thereof shall be resolved through binding arbitration in Miami-Dade County, Florida, in accordance with the rules of the American Arbitration Association. The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION.

13. Termination

We may terminate or suspend your access to the Site immediately, without prior notice or liability, for any reason, including without limitation if you breach these Terms. Upon termination, your right to use the Site will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including without limitation ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

14. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Company regarding the use of the Site and the purchase of Products, superseding any prior agreements between you and the Company.
